Procter and Gamble - Men's Challenge Jet Fighter Competition

  1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  2. Entry is open to all residents of Australia. Employees and their immediate families of Procter & Gamble, participating retailers, Night & Day Communications (the agency conducting this promotion on behalf of Procter & Gamble), and their associated agencies and companies are not eligible to enter.
  3. The Promotion opens at 00:01 on 03/08/09 and closes at 23:59 on 13/09/09 ("Promotion Period"). Mail entries must be received by last mail on 18/09/09.
  4. To enter, an Eligible Entrant will be required to, during the Promotion Period, purchase any Gillette Fusion, Head & Shoulders or Braun product from a participating retailer where entry forms are available from, and then submit their entry via one the following entry mechanic:
    1. Complete the entry form provided in-store (retain a copy of the purchase receipt as proof of purchase) and mail the completed entry form to: Men's Challenge Jet Fighter Competition. PO Box 153, Malvern VIC 3144, or
    2. Go online to www.menschallenge.com.au and complete the online entry form as required.
  5. The Promoter holds no responsibility for lost, late or misdirected entries. Entrants will be required to hold on to a copy of their store receipt (for each entry they have made) as proof of purchase in the event they are drawn a winner.
  6. For each Mail entry submitted, each entry form must be sent in a separate, stamped, standard sized envelope. Envelopes with multiple entry forms/coupons will be treated as a single entry. Only original entry form/coupon will be accepted, no photocopies allowed.
  7. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
  8. Incomplete, incomprehensible and illegible entries will be deemed invalid.
  9. Entrants may enter multiple times (in accordance with Condition 5), however only one prize per person and/or household will be permitted (excluding SA residents who are entitled to win more than one prize).
  10. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity in the form of a copy of store receipt for each entry they have made, in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  11. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple, street addresses or PO Box addresses to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.
  12. The cost of accessing the promotional website will be dependant on the entrant's individual Internet Service Provider.
  13. The prize draw will take place at Oxygen Marketing Pty Ltd, 2-6 Glenferrie Road, Malvern VIC 3144 on 22/09/09 at 11.30am (AEST).
  14. The first valid entry drawn from each participating retailer will each win a Jet Fighter experience valued at a maximum value of $2650 (NSW, VIC, TAS) or $5650 (all other States). The Jet Fighter experience will be supplied by Red Balloon Days www.redballoonsdays.com.au and is only available at the following locations:
  15. Winners who reside outside of NSW, VIC or TAS will be provided with two return economy airfares from the winner's capital city to one of the above mentioned Jet Fighter locations as determined by the Promoter, 1 night's twin share accommodation in a minimum 3 star hotel and 2 days car hire. Total maximum value of travel component is up to $3000. Winners from NSW, TAS & VIC will be responsible for their own travel arrangements to and from the venue. The next 50 valid entries drawn will each win a $100 Red Balloon Days Gift Voucher. The voucher will be subject to it's own separate Terms and Conditions available at www.redballoondays.com.au.
  16. Total maximum prize pool is valued at up to $27,600 RRP (including GST).
  17. Jet Fighter Experience prize winners will be responsible for all other expenses including spending money, meals, drinks, transfer to and from the venue (unless specified), additional activities (unless specified), incidentals, travel insurance and all other ancillary costs. The prize must be taken with 6 months from the time of draw and is subject to prize, hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made. This experience is subject to weather conditions. In the event of inclement weather the flight will be rescheduled for a later date. Participants must not weigh more than 110kgs or exceed height max of 6ft 2. Minimum age 13 years old. Winners must agree to the suppliers Terms and Conditions to partake in this experience and can be found www.redballoondays.com.au.
  18. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in the Jet Fighter experience should they be chosen as winners. The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the prize or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.
  19. Prizes cannot be transferred or redeemed for cash.
  20. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
  21. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  22. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes delayed or lost in transit.
  23. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
  24. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  25. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  26. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  27. If the competition winner is under 18 years of age, the prize will be awarded to the winner's parent or legal guardian.
  28. All winners will be notified in writing advising them of their prize and their name published in The Australian newspaper on 29/09/09.
  29. Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
  30. The Promoter may conduct such further draws as are necessary at the same time and place as the original prize draws on 07/01/10 in order to distribute any prizes unclaimed by that date, subject to any written directions given under relevant State or Territory legislation. In the event of any winners, they will have their details published in the Public Notices section of the Australian on 11/01/10.
  31. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the Competition result.
  32. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.
  33. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
  34. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  35. Procter & Gamble, Night & Day Communications, Oxygen Marketing Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  36. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
  37. All entries become the property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting the Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants and to State and Territory gaming authorities where required to do so. A request to access, update or correct any information should be directed to the Promoter.
